Terms and Conditions

1. General Provisions

Online store RABEKO.BIZ operating at www.galeriakoloru.pl is run by the company F.H. Rabeko Arkadiusz Rabeko, based in Warsaw, 03-161 Kiersnowskiego 16c, entered into the business register maintained by the Białołęka District Board of the City of Warsaw under number 113345, with NIP: PL 9510021454 REGON 011946214
Terms used in these Terms and Conditions shall have the following meanings:

  •     Store – the online store operating at www.rabeko.biz, selling products listed in its offer.
  •    Owner – FH Rabeko Arkadiusz Rabeko.
  •     Warehouse - the location of FH Rabeko’s warehouse from which shipments are fulfilled.
  •     Client – any entity purchasing goods or services in the Store in accordance with these Terms and Conditions.
  •    Client Account – an area containing data on conducted transactions and serving as a tool for placing orders by the Client.
  •     Business Days – days of the week from Monday to Friday, excluding statutory holidays.
  •     Terms and Conditions – this document defining the rules and conditions of using the Store and purchasing products, available at the address above.


2. Order Fulfilment

  1. The offer is addressed to companies, institutions, and individuals conducting business activities. The wholesale store does not serve private individuals.
  2. The condition for order fulfilment is providing correct data.
  3. To use the Wholesale Store, one must register in the system. By registering, the Client accepts the Wholesale Sales Terms and Conditions.
  4. To place an order, the Client should perform at least the following actions, some of which may be repeated multiple times:
    1. adding a product to the cart
    2. choosing the place of delivery
    3. placing an order in the Wholesale Store by using the “Order” button.
  5. The Client may at any time view, correct, update data or delete the Store account.
  6. The contract with the Client is concluded upon placing an order and its confirmation by the Wholesale Store.
  7. Orders can be placed 7 days a week, 24 hours a day.
  8. All prices in the Wholesale Store are net prices and are expressed in Polish zloty or EURO depending on the selected currency. EURO is converted according to the rate 4.30. If the rate increases, the Store reserves the right to adjust prices to the current rate.
  9. Each order is accompanied by a VAT invoice.

  11. In case of missing ordered goods in the warehouse, the Wholesale Store will inform the Client and provide the extended order fulfilment time.
  12. Orders are shipped within 15 business days.
  13. Orders are shipped via GLS courier for parcel orders or DSV for pallet orders.
  14. Upon receiving a shipment, one should check its condition in the presence of the courier and in case of damage or violation, prepare a damage report in the courier’s presence, which serves as a basis for processing complaints.
  15. The Wholesale Store reserves the right to change product prices. This does not affect the prices of products ordered before the price change.
  16. Product photos and their colors may differ from their actual appearance.
  17. The Wholesale Store follows the code of good practices.
  18. The Client uses products purchased in the Wholesale Store at their own risk.
  19. It is prohibited to share the Client Account with third parties, including other business entities or unauthorized individuals. In the event of such action, the Wholesale Store reserves the right to change the assigned Client Price Level to Price List D or permanently delete the Client Account from the Wholesale Platform. Such action will be treated as a gross violation of the Terms and Conditions and may result in immediate termination of cooperation.

 

3. Payments

  1. At the beginning of cooperation, prepayment to the bank account is required for the first 6 orders. Afterwards, the Client may apply for an invoice with deferred payment depending on the applicable price list.
  2. The Wholesale Store will not process an order if the Client has unpaid previous orders.
  3. Payment methods:
    1. prepayment to the bank account number: 94 1140 2004 0000 3902 4554 8686
    2. payment upon receipt of the shipment (cash on delivery)
    3. invoice with deferred payment term (after prior agreement)


4. Complaints

  1. Based on Art. 558§1 of the Civil Code, the Wholesale Store completely excludes liability towards Clients for physical and legal defects.
  2. If the Client finds manufacturing defects, mechanical damage, or notices that the received goods do not match the order, they may use complaint rights. Contact Customer Service at 22 679 99 61 or send an email to biuro@rabeko.pl, then return the goods together with the complaint form available on the Wholesale Store website.
  3. The Wholesale Store does not accept any shipments returned by the Client at the recipient’s cost.
  4. Complaints are processed within 14 days from the date of receiving the complained goods.
  5. If a complaint is accepted, the goods will be replaced with fully functional ones, or if not possible, the costs incurred will be refunded. The Client may also keep the complained goods and request a price reduction.
  6. The Wholesale Store refunds the payment using the same method the Client used unless the Client expressly agrees to another cost-free method.
  7. Differences in the appearance of goods (e.g., different packaging of the same product or differences due to Client’s monitor settings) do not constitute grounds for complaint claims.


5. Personal Data

  1. Making purchases in the Store requires providing all data requested in the form and checking the appropriate box (checkbox) indicating the Client’s consent to the processing of their personal data by the Owner, and the checkbox confirming they have read and accepted these Terms and Conditions.
  2. All Client data provided during registration will be used solely for the purpose of fulfilling, changing, or terminating the Agreement or other marketing activities, particularly informing about new Store products and services, provided the Client has consented via the appropriate checkbox to receive commercial information electronically, in accordance with the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).
  3. All personal data of the Client will be processed by the Owner in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 101, item 926 of 2002, as amended).
  4. The administrator of the Client’s personal data is the Owner.
  5. The data administrator is not responsible for providing false or incomplete personal data by the Client.
  6. The Client can access their personal data at any time after logging in to the Store, with the ability to modify, correct, or delete it.
  7. No elements of the Client’s personal data will be shared with third parties for any purpose other than fulfilling the Agreement, particularly delivery and payment processing.


6. Privacy Policy

  1. The administrator of personal data provided by Consumers of the store is the Seller.
  2. The Seller processes the User’s personal data based on Art. 6(1)(b) GDPR to the extent necessary to establish, modify, terminate, and properly execute electronic services, including statistical purposes. By providing personal data when placing an order, the Buyer consents to its processing by the Seller for order fulfilment. The Buyer may at any time view, correct, update, or delete their personal data.
  3. The Store does not automatically collect any information, except information contained in cookies.
  4. Cookies are data files, in particular text files, stored on the User’s device for use on the Store’s website. Cookies typically contain the name of the website they originate from, storage duration on the device, and a unique number.
  5. The entity placing cookies on the User’s device and accessing them is the Store operator.
  6. Cookies are used to:
    1. adjust website content to User preferences and optimize website usage; in particular, cookies allow recognizing the User’s device and appropriately displaying the website according to their individual needs;
    2. create statistics that help understand how Users interact with the website, which allows improving its structure and content;
  7. The Store uses two main types of cookies: “session” and “persistent.” Session cookies are temporary files stored on the User’s device until leaving the website or closing the browser. Persistent cookies are stored for a specified period in the cookie parameters or until deleted by the User.
  8. The Store uses the following types of cookies:
    1. “necessary” cookies that allow use of services within the Store, e.g., authentication cookies for services requiring login;
    2. security cookies, e.g., for detecting abuse in authentication;
    3. “performance” cookies, enabling collection of information on website usage;
    4. “functional” cookies, enabling remembering User settings and personalizing the interface, e.g., chosen language, region, font size, website appearance;
    5. “advertising” cookies, enabling delivery of advertising content better matched to User interests.
  9. In many cases, browsers allow storing cookies by default. Users can change cookie settings at any time, including blocking automatic cookies or being notified about them. Details are available in browser settings.
  10. The Store operator informs that cookie restrictions may affect some website functionalities.
  11. Cookies on the User’s device may also be used by cooperating advertisers and partners.

7. Cookies

  1. The Store uses “cookies” to improve usability, functionality, and ease of navigation. Cookies help Clients move quickly through the Store, measure page views, and track the most viewed products. Cookies are small text files stored on the computer system. Some of them are transferred from the Store’s server to the Client’s system. Cookies can be blocked at any time if the browser supports it. Blocking cookies may limit or disable some Store functions.
  2. Consent to receiving commercial information electronically
  3. Every User can subscribe to the newsletter-commercial information. Subscription occurs by checking the appropriate box during registration. Users may unsubscribe at any time via the link in the newsletter or by informing the Store via email. Upon unsubscription, the email address is immediately removed from the database.
